TikTok went to federal appeals court on Monday, Sept. 16, 2024 to fight its possible ban in the U.S. The popular video app and ByteDance, its Chinese parent company, sued to block the ban. These oral arguments were expected to lead to a potential Supreme Court battle.

The U.S. government says the app, owned by the Chinese, is a national security concern that gives China too much access to Americans' sensitive information. TikTok and parent company ByteDance argue that a ban would violate the First Amendment, saying it would have a "staggering" impact on free speech.

  • ByteDance could circumvent a ban by selling the app to a buyer approved by the U.S. government, but it's been argued that a sale "isn’t legally, commercially or technically feasible" by the January 19, 2025 ban deadline.
  • About 32% of Americans support a TikTok ban, down from 50% in March 2023, according to the Pew Research Center.
